Terms & Conditions
These Terms and Conditions govern access to and use of the site mxmisrt.com and the real estate crowdlending platform operated by Mxmisrt S.A.P.I. de C.V., Collective Funding Institution, tax ID MXM260315ITF, with tax domicile at Av. Paseo de la Reforma 296, Floor 17, Mexico City.
1. Acceptance
By accessing the site or creating an account, you acknowledge having read, understood and fully accepted these Terms, as well as the Privacy Notice and the Cookie Policy.
2. Nature of the service
Mxmisrt operates a technology platform that connects borrowers with investors under article 16 of the Mexican Fintech Law. Mxmisrt does not provide any guarantee of return or recovery of invested capital.
3. Investor requirements
You must be an adult individual or a legal entity incorporated in Mexico, with legal capacity to contract and with a bank CLABE in your name. We may reject account openings based on risk or compliance criteria.
4. Risk warning (Art. 11 Fintech Law)
Neither the Federal Government nor the entities of the parastatal public administration may be held liable for or guarantee the resources of Clients used in operations carried out with ITFs, nor assume any responsibility for obligations incurred by an ITF or any Client toward another.
5. Fees
The current fee schedule is published in the Pricing section of the site and forms an integral part of these Terms. Any modification will be notified with 30 calendar days in advance.
6. Intellectual property
The Mxmisrt brand, logo, texts, graphics and software developments are the exclusive property of Mxmisrt S.A.P.I. de C.V. Their total or partial reproduction without prior written authorization is prohibited.
7. Jurisdiction
These Terms are governed by the laws of the United Mexican States. Any dispute will be submitted to the competent courts of Mexico City, expressly waiving any other jurisdiction.
